Ixnay on Prop 77 redistrictingIt appears that Governor Schwarzenegger's
redistricting initiative, Prop 77, is dying a slow, painful (and in my opinion,
richly deserved) death.
Since news broke of the discrepancies between the version of the initiative circulated on
petitions and the version submitted to the Secretary of State's office, a great
deal has happened — most of it bad, if you're in favor of Prop
77.
Legislators (being legislators) scheduled hearings and signed on to the lawsuit attempting to block it from the ballot. Briefs were filed on both sides. After a short hearing and an even shorter deliberation, a judge found that the discrepancies violated the law and that the initiative could not appear on the fall 2005 ballot (a .pdf of the decision is here). Never ones to take a legal decision lying down (and probably used to being sued at this point), Ted Costa et al. filed an appeal, which will be heard by the Third Circuit (which did not recuse itself despite the fact that a former member is on the Prop 77 litigation team) this coming Friday.
